Wakefield Workers’ Compensation Attorney

Workers Compensation – Types of Benefits

Under the MA Workers Comp Act (M.G.L. Chapter 152), if you are injured on the job, you may be entitled to certain benefits. These include weekly disability benefits, and medical benefits related to your work injury.

Weekly Disability (Indemnity) Benefits:

  • Section 34 – Temporary Total – if you are completely unable to work at all as a result of your injury at work, you’re entitled to weekly payments of 60% of your gross, pre-injury weekly wages, for up to 3 years.
  • Section 35 – Temporary Partial – if you are injured and this results in a partial disability, you could be entitled to various amounts of partial disability benefits, representing a portion of your reduced earnings, for up to 5 years. A common example is when an injury results in an employee working reduced hours. Because of the decrease in pay, partial disability provides a supplement to make up for a portion of these lost wages.
  • Section 34A – Permanent and Total – if your injury results in total disability on a permanent basis, you could received weekly benefits of 66% of your gross pre-injury wages, indefinitely (ie, for the rest of your life).

Medical Benefits

Sections 13 & 30 of the MA Comp Law provide that the workers comp insurer is responsible for all medical benefits that are reasonable, necessary, and related to the injury at work. Sounds simple, but that’s not often the case. Workers Comp Insurers frequently contest responsibility for the payment of medical benefits, most often on the grounds that the treatment is related to a preexisting, non-work-related condition. This is why reporting any and all injuries to your doctor is so important. Report EARLY AND OFTEN!
